You should take all necessary steps to prevent unauthorized use of your account. 2. Your account vs your order (confused , must inspect)

We consider only the name of the TAP2DEAL account holder as the owner and user of the product(s) ordered from that account. You should not request any changes to the account holder’s name at the time of product delivery.

TAP2DEAL reserves the right to ban, cancel, freeze, or unfreeze your account(s) at its sole discretion. TAP2DEAL is not obligated to provide any remaining cashback balance if your account is blocked or banned. Any payments made by you via bKash, bank transfer, or cash will be refunded within a reasonable time period. Please note that refunds may depend on the calculation of your total payment versus the cashback you received and used.

3. Your Conduct:

You must not use the Site in any way that causes, or is likely to cause, interference, damage, or disablement to the Site or access to it. You must also avoid activities that could harm or potentially harm the Site, its employees, officers, representatives, affiliates, or any other parties directly or indirectly associated with the Site. You understand that you, not us, are responsible for all electronic communications and content sent from your computer to us, and you agree to use the Site only for lawful purposes. You are strictly prohibited from using the Site in any unauthorized manner.

TAP2DEAL.COM shall not be liable to any individual for any loss or damage arising from the use of any information contained in the materials on this site.

to share content that is harmful to third parties, promotes money laundering or gambling, endangers minors, impersonates another person, or threatens the unity, integrity, security, or sovereignty of Bangladesh or friendly relations with foreign states;

to distribute material containing software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam”;

for any illegal purpose;

to cause irritation, inconvenience, or unnecessary anxiety; or

for any purpose other than as intended by us.

4. Submission:

Anything that you submit to the Site or provide to us, including but not limited to questions, reviews, comments, and suggestions (collectively, "Submissions"), will become our sole and exclusive property and will not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews on the Site, you grant us the right to use the name you provide in connection with such review, comment, or other content. You must not use a false email address, impersonate anyone else, or otherwise mislead us or third parties regarding the origin of any Submissions. We may, but are not obligated to, remove or edit any Submissions without notice or any legal obligation on our part.

5. Claims against objectionable content:

We list a wide range of products on the Site, and we also host reviews and comments on listings. However, it is not possible for us to review the content of every product listed for sale or each review or comment displayed. Therefore, we operate on a "notice, review, and takedown" basis.

If you believe that any content on the Site is illegal, offensive (including but not limited to explicit content, or content that promotes racism, discrimination, hatred, or physical harm), misleading, abusive, obscene, harassing, defamatory, vulgar, obscene, pedophilic, or threatening; ethically questionable, libelous, or harmful to third parties; related to or promoting money laundering or gambling; harmful to minors in any way; impersonates another person; or threatens the unity, integrity, security, or sovereignty of Bangladesh or friendly relations with foreign states; or is otherwise unlawful or harmful in any way, including containing malicious software ("harmful content"), please promptly notify us by emailing legal@tap2deal.com

We will make reasonable efforts to investigate and remove any content that violates these guidelines within a reasonable timeframe.

Please ensure you provide your name, address, contact details, and as many relevant details about the issue as possible, including the name of the party responsible for the harmful content, specific instances of the complaint, and any supporting evidence. Please note that providing incomplete information may hinder your case and render it unusable for legal purposes.

6. Claims against infringing content: 

We respect the intellectual property rights of others. If you believe that your intellectual property rights have been infringed upon, please notify us, and we will make every reasonable effort to address your concern within a reasonable timeframe. Please ensure that you provide your name, address, contact details, and as many relevant details as possible, including the name of the infringing party, examples of the infringement, and evidence of the infringement. Please note that providing insufficient information may hinder your case and render it unusable for legal purposes. Additionally, providing false or misleading information may be considered a legal offense and could lead to legal action.

While we cannot provide legal advice or share private information protected by law, we recommend that any questions or concerns regarding your rights be directed to the appropriate legal authorities.

7. Indemnity:

You agree to indemnify and hold harmless TAP2DEAL, its subsidiaries, affiliates, and their respective officers, directors, agents, and employees from any claim, demand, or action, including reasonable attorney's fees, made by any third party or penalty imposed due to or arising from your breach of these Terms and Conditions or any document incorporated by reference, or your violation of any law, regulation, rule, or the rights of a third party.

You explicitly release TAP2DEAL, its affiliates, and any of its officers and agents from any cost, damage, liability, or other consequences of the actions or inactions of merchants or other service providers, and you explicitly waive any claims or demands you may have against them under any statute, contract, or otherwise.

8. Losses

We will not be liable for any business or personal losses (including but not limited to loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditures) or any other indirect or consequential losses that are not reasonably foreseeable by both you and us when you began using the Site.

9. Corrections to conditions or alterations of service and related promise :

We reserve the right to make changes to the Site, its policies, these terms and conditions, and any other publicly displayed terms or service commitments at any time. You will be subject to the policies and terms and conditions in effect at the time you use the Site, unless any change to those policies or terms is required by law or government authority (in which case, it will apply to orders previously placed by you). If any of these terms is found to be invalid, void, or unenforceable, that term will be considered severable and will not affect the validity and enforceability of the remaining terms.

10. Waiver

You acknowledge and understand that we are a private business entity and reserve the right to conduct our operations to achieve our objectives in a manner we deem appropriate. You also acknowledge that if you violate the terms stated on our Site and we take no action, we are still entitled to exercise our rights and remedies in any other situation where you breach these terms.

11. Administering Law and Jurisdiction :

These terms and conditions are governed by and construed in accordance with the laws of the People’s Republic of Bangladesh. You agree that the courts, tribunals, and/or quasi-judicial bodies located in Dhaka, Bangladesh, shall have exclusive jurisdiction over any disputes arising within Bangladesh under this Agreement.

12. Offers:

TAP2DEAL is not liable or bound to provide any other offers of any merchant/importer/ vendors’ at any other places/sites except TAP2DEAL. You can just request/ask/solicitation or look for data about the offers given/declared by TAP2DEAL.

One client will have the option to buy one item during any special offers (*if not allowed and announced multiple quantities by TAP2DEAL).

13. Valuing, availability and order processing : 

All prices are listed in Bangladeshi Taka (BDT) and include VAT. Items in your Shopping Cart will always reflect the most current price shown on the product detail page. Please note that this price may differ from the price shown when you first added the item to your cart. Adding an item to your cart does not lock in the price at that time. It is also possible that the price of an item may change between the time you place it in your cart and when you purchase it.

While we strive to provide the most accurate pricing information on the Site, errors may still occur. For example, a product's price may not be displayed correctly on the Site. In such cases, we reserve the right to refuse or cancel any order. If an item is mispriced, we may, at our discretion, either contact you for instructions or cancel your order and notify you of the cancellation. We reserve the right to cancel or reject any such orders, even if the order has been confirmed and your payment has been processed. In the event of such a cancellation, our refund policies will apply. Please note that TAP2DEAL reserves the right to determine the refund amount, which is generally based on the price the customer paid, after deducting any applicable discounts or shipping fees.

We list the availability information for products on the Site, including on each product’s information page. Apart from what is stated on that page or elsewhere on the Site, we cannot provide more specific details about availability. Please note that shipping estimates are just that — they are not guaranteed delivery times and should not be relied upon as such. As we process your order, you will be informed by email or SMS if any items you ordered become unavailable.

Please note that there may be occasions when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order at any time. You may be asked to provide additional verification or information, including but not limited to phone numbers and address, before we accept the order.

To prevent fraud with credit or debit cards, we reserve the right to obtain authorization of your payment details before providing you with the product and to verify the personal information you provided to us. This verification may include checking your identity, place of residence, or banking information. Failure to respond to such a request will automatically result in the cancellation of the order within a reasonable time frame. We reserve the right to proceed with the cancellation of any order where we suspect fraudulent use of payment methods or other reasons, without prior notice or any subsequent legal obligation.

14. Special Items :

SECURITY AND FRAUD

When you use a voucher, you warrant to TAP2DEAL that you are the properly authorized recipient of the voucher and that you are using it in good faith.

If you redeem, attempt to redeem, or facilitate the redemption of a voucher to obtain discounts to which you are not entitled, you may be committing a civil or criminal offense.

If we reasonably believe that any voucher is being used unlawfully or fraudulently, we may reject or cancel any voucher/order, and you agree that you will have no claim against us in relation to any rejection or cancellation. TAP2DEAL reserves the right to take any further action it deems appropriate in such circumstances.

15. Mass Purchasing :

TAP2DEAL sites are available for non-commercial and personal use only. We reserve the right to reject or cancel your order if we believe you are purchasing our products for business or resale purposes. We impose limits on some of our products to ensure stock availability, so that as many of our customers as possible have the opportunity to purchase our products.

16. Reselling TAP2DEAL products :

Reselling TAP2DEAL products for business purposes is strictly prohibited. If any unauthorized individual is found engaging in this activity, legal action may be taken against them.

17. Stock availability :

Orders are subject to stock availability. If there is any issue with the stock, the order may be canceled at any time, regardless of the duration.

18. Delivery Timeline :

Delivery may take longer than the usual timeframe set by TAP2DEAL. As per government laws and policies, TAP2DEAL will deliver any item that is in physical stock within 10 working days. However, TAP2DEAL will make every effort to deliver your items as soon as possible. Delivery may be delayed due to force majeure events, which include, but are not limited to, political unrest, political events, national/public holidays, natural disaster or movement restrictions, etc.

19. Delivery Charge(s) :

a) Delivery charge(s) applicable.

b) The provision of home delivery is subject to the carrier's delivery policy.

c) If a delivery fails due to customer negligence or any other reason on the customer's end, the customer will be responsible for paying the return courier charges as well as the redelivery charges.

20. Returns Policy :

1. If your item is faulty, damaged, or incorrect/incomplete at the time of delivery, please contact us within the relevant return window. Your item may be eligible for a refund or replacement, depending on the product category and condition.

2. Please note that some items are not eligible for return if the reason is "No longer required."

3. For device-related issues after use or after the return window has passed, we will refer you to the brand's warranty center (if applicable).

4. Please ensure that you retain and are able to provide proper documentation and proof for your return/refund claim (e.g., unboxing video, receipt, etc.).

21. Cancellation :

TAP2DEAL reserves the right to cancel any order at its sole discretion prior to dispatch and for any reason, which may include, but is not limited to, the product being mispriced, out of stock, expired, defective, malfunctioning, or containing incorrect information or descriptions arising from technical or typographical errors, or for any other reason.

22. Refund :

If any order is canceled, the payment for such order will be refunded (APPLICALE FOR ADVACED PAYMENT) within 7 working days. However, it may take longer in exceptional cases related to payment gateways, government authorities, or other factors. Please note that any received cashback, bonus, apology amount, or gift amount, if applicable, will be adjusted against the refund amount.
